Acronis True Image is a Windows-based computer backup and recovery tool. It allows for the backup and recovery of a computer's hard disk, files, directories, or complete partitions from any location without affecting the existing operating system. The plaintiff's lawyers argued that the company violated the act by selling unlicensed copies of True Image, which is protected by U.S. copyright law under 17 U.S.C § 106A, and that the Supreme Court had previously held that this act had to be narrowed to apply only to devices or devices designed for use with copyrighted works. A settlement fund of US$2.5 million was established, with Acronis agreeing to pay US$2 million to the plaintiff's attorneys, US$0.5 million in costs, and US$500,000 for distribution of copies of True Image Software containing the allegedly infringing code. An attempt against Acronis by Austrian law firm Dr. Holzinger & Partner was made on May 6, 2008. On June 3, the court in Vienna found against Acronis, ordering it to stop distribution of True Image 2008 within Austria within 14 days.
